Thank you very much for your excellent editorial in today’s BEE. We appreciate a fair and balanced opinion. The Stanislaus Taxpayers Association works on specific issues that are either bad for, or good for, the taxpayer. What happens too often, especially when elected officials have been in office too long, is that they forget they work on behalf of their constituents, many of whom are Taxpayers. We fear that the current city council and its mayor, have simply disconnected with the Taxpayers. The editorial correctly mentions each concern that the STA has regarding charging for a mandated speech. A majority of voters voted for Ridenour on the theory that he was the best candidate to represent them (I am one who voted for him). He must, apparently, be reminded that he is supposed to be the watchdog and ombudsman for ALL Modestans, those who voted for him, those who voted against him, and those who never voted. The mayor says the $40 dollar fee proves he is interested in jobs and economic development; too bad he has failed miserably in that effort for the last six years. Just drive from 1010 10th St to Needham. I think you will count 18 closed businesses in those six blocks. And, we just lost the best hardware store in the city; where was the mayor? Perhaps he could give speeches at $200 per, and really stimulate the economy? The mayor wants business to cooperate with government! That is so wrong it is difficult to believe he said it. It is precisely his city government who impedes business. The mayor’s government burdens business’s with an immoral gross revenues or “mill tax”; its sign law is stupid; it is so inept that developers commonly wait 18 months for their plans to be approved; it cannot keep roads repaired, so businesses leave for locations outside city limits in order to be accessible; crime threatens business owners and their employees, while the mayor works for the Sheriff. The editorial correctly addresses the mayor’s unbelievable “bellyache” comment. This is exactly the disrespect demonstrated by his government and his council. We hope the mayor takes the advice offered in the editorial. Let us see if he panders to the elite, or respects his constituents. Dave Thomas

 THE JUDGE DOES NOT LIKE MY SUN GLASSES THE FIRST DAY OF TESTIMONY IN THE LYDIA LOPEZ TRIAL Today, I attended the first day of testimony up until the afternoon recess. Jeff Hubbins, the lead attorney for Lydia Lopez was about 45 minutes late for court due to a jack-knifed trailer on the freeway. Judge Hurl Johnson took the time to give his instructions to the Jury on what was going to happen during the trial. Jurror # 10, the foreman of the jury was excused due to economic hardship, and was replaced by another gentleman named Brent Rasmussen. Jeff Hubbins arrived, and began his opening statements. He made the point that the jury only has to find that it is more likely than not to decide guilt in a civil trial, and that equal weight can be given to direct and non direct testimony in the trial. The opening statement by Hubbins began with a discussion of Lt. Pooley, who is one of the defendants in this case, who had worked for the SDEA. It was described how Lt. Pooley had placed Lydia Lopez,s hand on his penis, and how it was witnessed by a janitor who had just entered the room where they were. A second incident was described how Lydia had found a Betty Boop doll on her desk with a plastic action hero figure positioned in the “69” position on Betty Boop, and how Lt. Pooley had made some snide remark about the dolls. Another incident was described how Pooley was looking at her legs when Lydia was typing a search warrant, and that she had gone to the bathroom to change into some shorts. When she came back, Lt. Pooley told Lydia that he liked her much better with her shorts off. Jeff Hubbins described how a couple of weeks later, Lydia was transferred out of the SDEA, and put on grave yard shift. Jeff Hubbins described how this caused Lydia distress, and anxiety, and that her Doctor had prescribed Paxill for her, and had written a note that said that Lydia could not work grave yard shift for one month because of medical reasons. The county wanted two more letters from the Doctor, and eventually let her work days, but decreased her job level by two pay levels. Jeff then described how the Doctor had upped the dose of Paxill, and wanted 21 more days of day shift. The county gave her an ultimatum to work grave yard or else, so Lydia showed up. The county instituted an internal affairs investigation on Lydia’s time cards. The county found that Lydia had been cheating on her time card by marking down every day that she worked from 8 AM to 5 PM, when actual hours often differed. Jeff Hubbins told how this practice was common practice amongst other Sherrif’s Dept. Employees, as well as employees from other county departments. Jeff referred to the practice as “Banking Hours, or Flex Time.” The county found that Lydia had cheated on the time cards, and sent her a “Notice of Termination.” The county had what is called a “Skelly Hearing” The #2 top cop Ray Hine wrote Lydia up, and placed her on a performance improvement plan rather than terminating her at that time. As a result of this meeting, Lydia had to call in whenever she was going to miss work, and personally speak to her boss, and had to sign in and out, and that her time cards had to be verified by her supervisor. Lydia found this to be impossible, because many times her supervisor was not there, since she was working nights. Lydia did not get verification on a couple of these time cards, and was found to be in violation of the terms of her performance improvement plan. Again, the county had a Skelly hearing. Lydia was transferred out of the office, and was put on rotating shifts of 2 weeks night shift, 2 weeks day shift, and 2 weeks PM shift. Lydia gave up. Lydia is suing Bill Pooley for sexual harassment, and Stanislaus County for harassment, failure to prevent harassment, and for disability discrimination, and for failure to employ the interactive procedure that should have been followed. Lydia is also suing for lost wages Loraine Jacob, the lead attorney that is defending the county, and Lt. Pooley then gave her opening statements. She stated that Lydia was feared to be a security risk in the SDEA because she is married to a documented Norteno gang member. Ms. Jacob described how Lydia had asked for overtime because her car had been repossessed, and wanted to be able to use an unmarked county car for her own use. Lydia was told NO. Loraine Jacob described how Lydia had unrestricted access to information on search warrants, informants, and that how they felt that Lydia was compromised by her money problems and being married to a documented Norteno gang member. Loraine Jacob then told of how all employees are told that they might have to work any or all shifts as necessary when hired by the county. Loraine Jacob said that the alleged penis touch incident never happened, and that Chris Martinez, the custodian will say that he was not there, and never saw the incident. Ms. Jacob also said that Lydia took 2 ½ years to complain about the sexual harassment, and witnesses will not back up Lydia’s testimony. Ms. Jacob stated that the doll incident never happened. Ms. Jacob made comments about Lydia engaging in “off color” talk at work with her co-workers, and how Lydia had sent and received sexual content E-Mails on the county computer system. Ms. Jacob stated that the evidence will show that Lydia requested night shift. Ms. Jacob said that Lydia’s doctors notes never informed the county that Lydia was suffering from depression, so the county could not be accused of mis handling her medical condition of

EDITORS NOTE: IT NOW APPEARS THAT JUDGE HURL JOHNSON WAS THE JUDGE THAT RULED THAT JIM RIDENOUR AND CARMEN SABATINO WOULD NOT BE TESTIFYING IN THE LYDIA LOPEZ TRIAL. I AM POSTING ANOTHER ARTICLE WRITTEN BY CARMEN THAT SEEMS TO MAKE THIS CLEAR. I WILL DO SOME MORE FACT FINDING ON THIS SUBJECT, AND WILL REPORT BACK TO THE READERS. WHOEVER MADE THIS RULING IS HOG TYING THE PLAINTIFF'S HANDS. IT SURELY IS RELEVANT WHETHER MAYOR RIDENOUR IS CHEATING ON HIS TIME CARDS, AND GETTING AWAY WITH IT, AND THEY FIRED LYDIA FOR THE SAME THING. I HEAR THERE ARE OTHER EXAMPLES OF COUNTY EMPLOYEES GETTING AWAY WITH FILLING OUT THEIR TIME CARDS IN THE SAME WAY AS LYDIA, WITH NO PROBLEMS FROM THEIR SUPERVISORS. IT SEEMS TO BE A COMMON PRACTICE WITH MANY COUNTY DEPARTMENTS. The Bee reports the trial with one paragraph in “News and Notes” and then goes to the Hive for more info. Jury selection for the trial begins this morning at 10. The court is at 10th and H Judge Beauchesne has removed former Mayors Ridenour and Sabatino from the witness list. Sabatino answered questions at his deposition. Ridenour refused to answer questions if he was deposed. Beauchesne rules that the Sheriff and Mayors calendar and timecards not relevant to Lydia Lopez time cards. Bee editor Judy Sly and reporter Adam Ashton find sheriff and mayor innocent of wrong doing. Beauchesne seems to be assigned cases involving the city and the county. The legal defense team is occupying office space at the Sheriff’s office…sort of a “command post”.
