Susanna Wood

Modesto City Attorney
Modesto, California

Re: Public Records Act Request

Dear Public Records Officer:

This is a request pursuant to the California Public Records Act, Government Code Section 6250, et seq. Copies of the following documents are requested:

As per our phone conversation.  In April, 2006 the Stanislaus County District Attorney’s Office offered to then defendant Carmen Sabatino a deal to drop ten felony charges in exchange for a fine of $4,700.00. Former Mayor Sabatino rejected the deal and went to trial.

Shortly thereafter, Mayor Jim Ridenour and the Modesto City Council voted in closed session to have City Attorney Michael Milich and City Clerk Jean Zahr demand that the District Attorney charge former Mayor Sabatino with an additional felony of providing dinner to the Modesto City Council prior to council meetings. The city paid for  the dinners at no expense to council members. The city wrongfully charged that the former mayor profited by doing business with the city.  At trial, the city attorney demanded restitution for the dinners the council ate at no cost to them.

After the trial, the District Attorney dismissed all charges.

We are requesting the vote of the council members in demanding prosecution and all correspondence between the Council, Milich, Zahr, and the District Attorney.

Please let me know in advance if there is a charge for copying these documents. Pursuant to Govt. Code § 6256, your written response within ten days will be appreciated.

Sincerely,

Carmen Sabatino

THE ONLY GOOD MID DIRECTOR IS MIKE SERPA

Good afternoon.  I bet you thought that the Modesto Irrigation District existed to provide you with light, heat and water.  Well, it does, but in a roundabout kind of way, it also does not!

Have you ever been to an MID board meeting?  Have you ever seen one on TV?  I’ll bet none of you have.  But if you did attend, you were probably not allowed to speak to a Board member, or address MID management, or ask a question.  Why?  Because they do not want you to.

One Board member has asked a lot of questions of management, and never received answers.  This Board member has also asked that MID meetings be televised, so you and I could watch or set our TV to record meetings, and watch at our leisure.  Unfortunately, his fellow Board members said “NO!”  In fact, they are pretty darned unwilling to allow any real information released to the RATE PAYERS.  You probably ask why.

Let me give you some reasons:

1.     They have spent many millions of rate payer’s money on the debacle known as Mountain House.  They are still pouring loot into that project, with no likelihood of ever breaking even.

2.     They allowed several buildings at Don Pedro to rot because of shoddy methods of building them.  They had TEN years to make the builder fix the problems.  They WAITED UNTUL THE STATUATE OF LIMITATIONS EXPIRED, AND NOW ARE BORROWING $9 Million dollars to fix them, and YOUR RATES ARE GOING UP TO RETIRE THAT DEBT.

3.     The MID Board has just raised your rates by 11.2% to pay for...well, um, we do not know.  THEY WILL NOT TELL US.

4.     DO YOU NEED TO KNOW MORE?

Now is the time to act.  The MID Board will meet at 9:00 AM on Tuesday, Feb. 17th.  You need to attend and tell them that they must televise their meetings.  You must be adamant, because they have FREE access to two ComCast cable channels.  Televising Board meetings will not increase your rates, but it WILL increase your KNOWLEDGE.  Three of the Board members are up for re-election in November.  They are the deciding votes, and you need to influence them.

Even if you attend, please send the Board an e-mail message about how you feel regarding their turning out the lights of truth on their very poor management.  Of course, you cannot message any individual board member, oh no, they do not allow that.  So, e-mail the group at

Whether you attend or not, please e-mail them.  But please try to attend.

Thank you very much, Dave Thomas, Stanislaus Taxpayers Association

BORAT...LIFE HAS BEEN VERRRY GOOD FOR ME

Mike Zagaris has just stated that he thinks our local real estate market has hit the bottom. This is at least the second time in the last six months that he has said the same thing, and the prices are continuing to drop like a rock. Around six months ago, Mike organized a bunch of local investors to buy up local properties for rentals. All of these rentals are now upside down. The investors paid more for the properties than they are presently worth, by quite a margin. Moody’s has just stated that our local real estate market will drop an additional 31% in the next 18 months. Who do you believe? I leave my articles on this web site forever, so check back in the future to find out who is correct.   Tux

JUST VENTING

Here we go all over again. Mayor Ridenour has just stated that he wants to lower the Developer Fees on new homes to be built in Modesto. The last time we lowered Developer Fees, Modesto lost out in over 100 Million dollars of fees that could have made Village One turn out the way it was supposed to turn out. It was a terrible mistake that we are paying for to this very day. I guess the citizens of Modesto should be the ones to pay for the needed infrastructure.

Is this yet another kissing of the ass of the mighty Zagaris? You know His Richness seems to need more Public assistance to keep building His fortune. Most of the people on the City Council seem to be in His hip pocket, so this will probably be history repeating itself all over again.                                                                      Tux
