Court Rules Against Overcharging of Water Customers

LOS ANGELES -- Some good news in the midst of the recession greeted
Los Angeles water customers when, on March 25th the Los Angeles
Superior Court issued a tentative ruling in LA vs. All Persons
finding the City's practice of padding water bills to pay for
unrelated City expenses to be unconstitutional.

The City has, for many years, charged its customers more than
necessary for their water in order to create an annual multi-million
dollar surplus in its Water Fund, which the City Council then spends
on other things. For example, in the 2006-07 fiscal year, the City
was set to transfer nearly $30 million from its Department of Water
and Power (DWP) to the General Fund, to be spent at the Council's
discretion.

However, in 2006, the Supreme Court ruled in Bighorn-Desert View
Water Agency v. Verjil that the provisions of Proposition 218, the
"Right to Vote on Taxes Act" apply to fees for water service.
Proposition 218 requires that fees charged for a property-related
service not exceed the cost of providing that service and "not be
used for any purpose other than that for which the fee or charge was
imposed."

The City filed a "validation action," suing all of its citizens, and
seeking a court order allowing the continued transfer of funds from
DWP to the General Fund. By filing a validation action against "all
persons," the City served its suit by running a small ad in a
newspaper, hoping no one would notice. The City chose a little-read
trade publication, but the ad was spotted by a concerned taxpayer
who contacted the Howard Jarvis Taxpayers Association. HJTA
attorneys then jumped to action, appearing in court on behalf of
their members who are Los Angeles water customers.

Judge Kenneth Freeman's tentative ruling states, "Proposition 218
prohibits the City and its Department of Water and Power from
transferring surplus revenue derived from water service fees to the
City's Reserve Fund, General Fund, or any other fund for expenditure
on non-water related purposes. The $29,931,300 transfer via
resolution number 007-106 and City Ordinance number 178451 is
unconstitutional and void." The Judge ordered that the transferred
money be repaid.

The City's lawyers have 10 days from the issuance of the tentative
decision to challenge it, otherwise the tentative decision becomes
final. When finalized, this decision will save DWP ratepayers more
than $30 million per year at today's rates ... a big win!

The crimes in Orange County are no less than what happens in Stanislaus County.  We must have a disconnect between law enforcement and politics in Stanislaus County.

 

The view that “nothing can be done” is no longer acceptable.  Those who committ or assist in committing crimes will be held accountable.

 

This includes lawyers, Supervisors, City Councilmembers, prominent businessmen, bankers, real estate appraisers and sellers, sub-prime mortgage companies, and those who scam millions in taxpayer money.

 

The harshest penalties for civil rights violations should be reserved for prosecutors, law enforcement officials, and even judges who have violated the public trust.

 

If you are having problems in these economic times, it is because we have failed to get the bad apples out of the barrel.

A little thing happened this week in the news that hasn’t made it to our local news yet.  Remember the Orange County Sheriff that went to trial recently?   You can search Sheriff Carona’s name and find many articles as to what his charges were, here are a few excerpts of statements from an LA Times article

 “Federal prosecutors say Michael S. Carona, accused of misusing the sheriff's office and compromising the public's trust, was driven by power and money.”

 “….federal prosecutors describing Michael S. Carona as a political manipulator whose ambitions were fueled by power and money.”

 “In the recordings, Corona sounds nothing like the polished orator who frequently spoke to church and civic groups; the conversations are punctuated with obscenities and racial slurs.”

 “On the tape, Corona bragged that he was the "most lethal" politician in Orange County”

 Well the former Orange County Sheriff Michael Corona was convicted in January of federal corruption of witness tampering, in having his Assistant Sheriff lie for him. The important part is that this felony conviction is one that the probation department this week completed their evaluation of the sentencing portion, and on Monday recommended to the court  a sentence of 78 months (6.5 years) in federal prison.  The judge is scheduled to hand down the sentencing in May based on the Probation Department recommendation.  

Additionally, jurors stated that they believed Corona had illegally accepted cash and gifts, but that they were hindered by a statute of limitations that prevented them from considering the rest of the alleged transgressions. One juror stated, Sheriff Corona’s “hand was in the cookie jar, he was just quick enough to wipe the crumbs off of his hands.”  The charges were based upon Corona’s misuse of his office for financial gain. 

Research it, folks.   I believe we’ll see similarities with the behavior of our Sheriff.   Is it time to look in detail to his campaign contributions and gifts, and confirm things like “buying a promotion” or buying favors.  This is the type of thing that the California Department of Justice will investigate.

1.    Lydia Lopez (Hispanic)- Sexual Harassment, Discriminated, etc. by chief Bill Pooley of Riverbank.

 

2.    Charmaine Daniel (Middle Eastern)- called a “Terrorist” by Bill Heyne, “Bitch” by Christianson, harassed, etc…

 

3.    Jackie Bernal (Hispanic)- Called a “Bitch” by Christianson, harassed, discriminated, etc…

 

4.    Marlena Younan (Middle Eastern)- Harassed, Intimidated, etc…

 

5.    Alejandra Arenevic (Hispanic)- Harassed, Intimidated, etc…

 

6.    New Additional Complaints : New Female (Middle Eastern)- Complaint filed with CEO of Sexual Harassment/Battery by a Sergeant. She was assaulted and then she was “Released from Probation,” accused of having “Gang” associations. She has contacted an attorney.

 

7. Three additional females- have filed EEOC complaints that they are being discriminated against because they are female.

The Mayor’s calendar, time cards, and the newspaper cover-up

If you’ve been following the controversy involving Modesto Mayor Ridenour and his job activities, you might be somewhat confused. It’s a little complicated to explain verbally.

If you’ve relied on our local newspaper for explanation, you must be REALLY confused. Despite sitting on this story for several weeks, the Bee’s only contribution was short August 12 piece combining equal parts inaccuracy and spin.

First, some background:

The Mayor is a part-time employee of the Sheriff’s Department, and fills out a daily time card.

Earlier this year, the Mayor submitted an “Activities Calendar” to the committee that was formed to recommend new salaries for the Mayor and members of the City Council. This report listed the Mayor’s activities – appointments, meetings, etc. – by date and time. The report covered the first four months of 2008.

Got it so far? Good, because here’s where it gets interesting. When you match up the Mayor’s time card from his Sheriff’s Department with his Activities Calendar you discover the following:

On no fewer than seventeen (17) separate dates, the Mayor’s time card placed him at work on his Sheriff’s Department job, while the activities report had him attending one or more meetings related to his position as Mayor.

This suggests that our mayor has the ability to be in two places at the same time, which is a pretty nifty trick.

Not to worry, though – the powers that be have circled the wagons and have floated an explanation, as follows:

The Sheriff’s Department time cards are accurate. So said Sheriff Adam Christianson, calling it “a whole lot of to-do about nothing.”

The mayor’s Appointment Calendar is also accurate. Well, sort of. City officials offered two explanations for the seeming conflicts:

1. The mayor participated in “agenda review” meetings by phone, while on county time.

2. The mayor didn’t attend or participate in any of the other “conflict” meetings or events listed on his calendar.

Why were they left on the calendar? Oh, not to impress the salary commission – no, not at all. Rather, the mayor said he kept them there “as a reminder of community events” (to quote the newspaper). If you can figure out what THAT means, please let us know.

Now, just for the record, and to give you a visual clue as to how many items we’re talking about, here’s a list of calendar entries that conflicted directly with the mayor’s time cards (the descriptions are taken for the calendar itself):

Even if you remove the agenda review items (there are 7 of these, all supposedly ‘attended’ by the mayor via phone), what remains is an incredibly long list of meetings ostensibly skipped or cancelled. You have to wonder: why were all of these scheduled in the first place? Why were they entered on the Activities Calendar?

More to the point, why were they left on the calendar when it was typed up for submission to the salary committee? The mayor’s reminder-of-community-activities explanation doesn’t pass an elementary sniff test.

Neither does his disingenuous statement that he wasn’t trying to influence the salary committee by giving them such a wildly inaccurate and misleading document. His statement is disingenuous because he has publicly complained about all the hours he has to put in the performance of his mayoral duties. The salary committee had requested the Appointments Calendar as verification of the mayor’s claims.

What they got was a work of fiction.

And who’s to vouch for the accuracy of the rest of the calendar? The conflicts listed above only came to light because they conflicted with the mayor’s time cards. What about the other entries?

Several things are certain: You won’t read any more about this in the local newspaper. They’re part of the establishment that’s protecting their own; they’ve printed their spin, and will ride out any backlash in silence.

The other certainty is this: the mayor’s image and credibility have been very badly damaged.
